Frente a los estudios que situaban los análisis foucaultianos acerca del nacimiento de la prisión en unas coordenadas próximas a los Análisis económicos de la pena, este artículo pretende romper con ese reduccionismo economicista. La prisión y las penalidades modernas aparecen en dichos análisis, directamente influidos por los historiadores marxistas ingleses, como respuesta a motines e ilegalismos que tienen un origen no solo económico sino fundamentalmente moral.

La problematización de la pobreza, la criminalización, encierro, reclusión y disciplinamiento de los pobres constituyen factores fundamentales para poder explicar con éxito el nacimiento del primer capitalismo. En este artículo queremos mostrar de qué forma la pobreza, que durante toda la Edad Media había sido naturalizada como una parte más de un orden divino, se convierte, a partir del siglo XVI, en una cuestión problemática que protagoniza apasionados debates. En esta nueva problematización de la pobreza encontraremos los mimbres con los (...) que posteriormente se tejerá toda una tupida red punitiva y disciplinaria que tendrá como propósito la creación de un ejército de trabajadores sumisos en condiciones de miseria. The allocation of any scarce health care resource, especially a lifesaving resource, can create profound ethical and legal challenges. Liver transplant allocation currently is based upon urgency, a sickest-first approach, and does not utilize capacity to benefit. While urgency can be described reasonably well with the MELD system, benefit encompasses multiple dimensions of patients’ well-being. Currently, the balance between both principles is ill-defined. This survey with 502 participants examines how urgency and benefit are weighted by different stakeholders. Liver transplant patients (...) favored the sickest-first allocation, although all other groups tended to favor benefit. Criteria of a successful transplantation were a minimum survival of at least 1 year and recovery of functional status to being ambulatory and capable of all self-care. An individual delisting decision was accepted when the 1-year survival probability would fall below 50%. Benefit was found to be a critical variable that may also trigger the willingness to donate organs. The strong interest of stakeholder for successful liver transplants is inadequately translated into current allocation rules. (shrink)

The significance of private standards and associated local level initiatives in agri-food value chains are increasingly recognised. However whilst issues related to compliance and impact at the smallholder or worker level have frequently been analysed, the governance implications in terms of how private standards affect national level institutions, public, private and non-governmental, have had less attention. This article applies an extended value chain framework for critical analysis of Private Standards Initiatives (PSIs) in agrifood chains, drawing on primary research on PSIs (...) operating in Kenyan horticulture (Horticulture Ethical Business Initiative and KenyaGAP). The paper explores the legislative, executive and judicial aspects of governance in these southern PSIs highlighting how different stakeholders shape debates and act with agency. It is argued that governance is exercised ‘beyond the vertical’ in that one can identify wider horizontal processes of governance, including how the scope of key debates is constructed (especially in legislative governance) but analysis of executive governance emphasises the dominant role of the lead buyers. The Internet of Things (IoT) is a fast-growing technology that connects everyday devices to the Internet, enabling wireless, low-consumption and low-cost communication and data exchange. IoT has revolutionized the way devices interact with each other and the internet. The more devices become connected, the greater the risk of security breaches. There is currently a need for new approaches to algorithms that can detect malware regardless of the size of the network and that can adapt to dynamic changes in the network. (...) Through the use of a multi-agent reinforcement learning algorithm, this paper proposes a novel algorithm for malware detection in IoT devices. The proposed algorithm is not strongly dependent on the size of the IoT network due to the that its training is adapted using time differences if the IoT network size is small or Monte Carlo otherwise. To validate the proposed algorithm in an environment as close to reality as possible, we proposed a scenario based on a real IoT network, where we tested different malware propagation models. Different simulations varying the number of agents and nodes in the IoT network have been developed. The result of these simulations proves the efficiency and adaptability of the proposed algorithm in detecting malware, regardless of the malware propagation model. (shrink)

Hospitals are paying increasing attention to the delivery of humanized care. The purpose of this study was to explore from the nursing perspective what hospital managers might do to facilitate this. A secondary analysis from a primary ethnographic study regarding dignity in nursing practice was conducted. Twenty interviews of internal medicine nurses from four hospitals were analyzed, and three main themes were identified: Management of nursing teams, Management of ethical values, and Management of the context. It is important for institutional (...) values to be closely aligned with those of the nursing profession, and nurse managers play a key role in ensuring that the latter are applied in practice. Over the past two decades the growth of the organic sector has been accompanied by a shift away from first party, or peer review, systems of certification and towards third party certification, in which a disinterested party is responsible for the development of organic standards and the verification of producer compliance. This paper explores some of the limitations of the third party certification model and presents the case of Mexico as an example of how an alternative form of participatory certification (...) has emerged. The paper suggests that participatory guarantee systems (PGS) are reflective of the growing “beyond organic” movement, which focuses on reconstructing the local and re-embedding food systems into their socio-ecological contexts. It argues that PGS offers a number of benefits for producers and consumers, particularly in the South, but that it faces a number of challenges as well, such as a lack of formal recognition, social conflicts and dependence on donated resources. In the case of an intellectually disabled patient, the attending physician was restricted from writing a Do-Not-Resuscitate (DNR) order. Although the rationale for this restriction was to protect the patient from an inappropriate quality of life judgment, it resulted in a worse death than the patient would have experienced had he not been disabled. Such restrictions that are intended to protect intellectually disabled patients may violate their right to equal treatment and to a dignified death.

Over the past two decades, Cuba has become a recognized global leader in sustainable agriculture. This paper explores how this process of agricultural transition has taken place, and argues that it has largely been led by research institutes, non-state organizations and the Cuban government, which have all contributed to the institutionalization of agroecology in both policy and practice. This process has been highly effective in terms of the numbers of people using agroecological techniques. However, although these techniques have been widely (...) adopted by farmers across the country, this paper suggests that many still perceive maximizing production to be a higher priority than maintaining a commitment to agroecological ideals. For these farmers, agroecological farming is viewed primarily as a pragmatic decision rather than an ideological or moral one, and they may thus be susceptible to shifting back to conventional production if this option became politically and economically feasible. The impact of digital devices and the Internet has generated various changes at social, political, and economic levels, the repercussion of which is a great challenge characterized by the changing and globalized nature of today's society. This demands the development of new skills and new learning models in relation to information and communication technologies. Universities must respond to these social demands in the training of their future professionals. This paper aims to analyze the empirical evidence provided by international studies in (...) the last eleven years, related to the digital literacy of university students, including those pursuing degrees related to the field of education. Our findings highlight the fact that the digital literacy that is offered in universities to graduate/postgraduate students, in addition to treating digital literacy as a central theme, also focuses on perceived and developed self-efficacy. This is done by strengthening competencies related to digital writing and reading, the use of databases, the digital design of content and materials, and the skills to edit, publish or share them on the web, or applications aimed at treating digital literacy as emerging pedagogies and educational innovation. Secondly, we found studies related to digital competencies and use of the Internet, social networks, web 2.0, or the treatment of digital risks and their relationship with digital literacy. El propósito de este artículo es el de rastrear la influencia que, en el desarrollo de este concepto de ilegalismos, tuvieron las lecturas de la obra de E.P. Thompson por parte de Foucault, el (...) diálogo silencioso que se establece entre ambos autores en torno a dos conceptos: el motín de subsistencia y los ilegalismos. Así como el análisis de la distinta significación y objetivo que va adquiriendo este concepto en la obra de Foucault. ABSTRACT The seventies are the most explicitly militant period in Foucault's career. A key concept in the first half of these years, and one that will prove fundamental, both in understanding the birth of prison and of crime, is that of illegalities. The purpose of this article is to trace the influence that readings of E.P. Thompson's work by Foucault had on the development of this concept of illegalisms, the silent dialogue established between the two authors around two concepts: the subsistence riot and illegalisms. With this volume of the series Logic, Epistemology, and the Unity of Science edited by S. Rahman et al. a challenging dialogue is being continued. The series’ first volume argued that one way to recover the connections between logic, philosophy of sciences, and sciences is to acknowledge the host of alternative logics which are currently being developed. The present volume focuses on four key themes. First of all, several chapters unpack the connection between knowledge and epistemology with particular focus on (...) the notion of knowledge as resulting from interaction. Secondly, new epistemological perspectives on linguistics, the foundations of mathematics and logic, physics, biology and law are a subject of analysis. Thirdly, several chapters are dedicated to a discussion of Constructive Type Theory and more generally of the proof-theoretical notion of meaning.Finally, the book brings together studies on the epistemic role of abduction and argumentation theory, both linked to non-monotonic approaches to the dynamics of knowledge. The Totonac homegarden is a traditionally designed agroecosystem mixing different elements, such as cultivated and wild plants, and livestock. Our objective was to understand the role and importance of homegardens as a strategy for subsistence and natural resources management. Anthropological fieldwork was carried out in Coxquihui, Veracruz, Mexico, a Totonac community. Conventional sampling using a questionnaire yielded a sample of 40 individuals, each representing a family group. Personal interviews, life stories, observations, and field transects enriched survey information. Fieldwork permitted identification (...) of four types of Totonac homegardens: backyards, cropping fields, acahuales or fallow fields, and fences or field edges. Each of these gardens yields an array of products and services important for several cultural roles and natural resource management aims. Totonacs see land as the dominant and most critical resource. A great deal of terrain is steeply sloped and soils are poor. Homegardens play a key role in a production system that minimizes these site limitations, striking a balance between resource maintenance and subsistence needs. Their functions are ecological, to foster a multistrata vegetation cover, and a continuous supply of organic matter to the soil; economic, serving as living storehouses where diverse products (food, timber, firewood, forage, animals, ceremonial supplies, medicinal products), are kept through the annual cycle; and social, performing various social roles such as growing medicinal, ritual, and edible plants, thus supporting beliefs and culture continuity. Studies like this contribute to a better understanding of Totonac culture and native ecology, and give ideas for a better land management. (shrink)

The collection and storage of human tissue samples has been present in medicine for centuries, however, biobanking has recently become a dedicated activity. The technological developments that have allowed the isolation, storage and long term viability of human cells ex vivo, and to obtain relevant scientific information, including genetic information, open tremendous possibilities for advancing biomedical research. At the same time, these possibilities have raised complex ethical issues regarding tissue donors, researchers using samples and society awareness of biobanking as a (...) whole. This article aims to review the operation of stem cell biobanks, related ethical issues and the legal framework in Spain. Special consideration will be given to the new but revolutionary appearance of induced pluripotent stem cells. Most of the topics discussed here will be in the framework of banking adult derived stem cells, which do not entail in themselves any significant ethical dilemma. (shrink)

Like biological species, languages change over time. As noted by Darwin, there are many parallels between language evolution and biological evolution. Insights into these parallels have also undergone change in the past 150 years. Just like genes, words change over time, and language evolution can be likened to genome evolution accordingly, but what kind of evolution? There are fundamental differences between eukaryotic and prokaryotic evolution. In the former, natural variation entails the gradual accumulation of minor mutations in alleles. In the (...) latter, lateral gene transfer is an integral mechanism of natural variation. The study of language evolution using biological methods has attracted much interest of late, most approaches focusing on language tree construction. These approaches may underestimate the important role that borrowing plays in language evolution. This article describes and proposes the “environmental subsidiarity principle” as a guiding ethical value in forestry governance. Different trends in environmental management such as local participation, decentralization or global governance have emerged in the last two decades at the global, national and local level. This article suggests that the conscious or unconscious application of subsidiarity has been the ruling principle that has allocated the level at which tasks have been assigned to different agents. Based on this hypothesis this paper describes (...) the principle of subsidiarity and its application to environmental policies within forest governance and proposes the “environmental subsidiarity” principle as a critical conceptual tool for sustainable resource management. The paper explains as an example how “environmental subsidiarity” is the key principle that can link payment for ecosystem services (PES) with environmental public policies and applies this principle with all its political consequences to reducing emissions from deforestation and forest degradation, and enhancing forest carbon stocks in developing countries (REDD+) architecture. It concludes by showing how the adoption of “environmental subsidiarity” as a ethical principle could help to maximize benefits to all stakeholders involved in PES schemes such as REDD+. (shrink)
